Terms of sale

The general conditions of sale will apply to all operations between Geotechnik Products, S.L. and their clients. Geotechnik Products, S.L. will only accept possible modifications to the clauses herein made in writing and by a legally competent person representing it.

The merchandise may be invoiced from the moment it is available to the buyer. Partial deliveries may be invoiced independently.

The merchandise travels at the buyer’s expense and risk, even in those cases in which the price was fixed until the destination. The buyer undertakes to check the quantity of materials supplied by the seller at the time of receipt.

The seller is not responsible for any expense, loss or damage incurred by the buyer due to delays in delivery.

The buyer undertakes upon delivery to check the good condition of the merchandise and its operability, declining Geotechnik Products, S.L. any warranty or liability other than strictly that of the product itself.

Invoice payments will be made strictly in the manner agreed upon and that appears on the invoice.

Any claims by the buyer regarding the goods supplied will not release him from payment within the stipulated deadlines.

Failure to pay an obligation when due causes the expiration of each and every one of the buyer’s ongoing obligations and makes payment claimable and enforceable. Any non-payment also gives us the right to resolve all ongoing operations regarding supplies pending service, without any formality and with reservation of claiming damages.

In the event of a decrease in the buyer’s solvency, or a change in its legal or financial situation, we reserve the right to terminate ongoing operations or require guarantees.

The buyer is responsible for late payments, agreeing in all cases to pay return costs and late payment interest.

Geotechnik Products, S.L. reserves all rights and ownership of the goods supplied until full payment thereof. The retention of the title of property will be subject to the entire order even if partial deliveries have been made and invoiced.

In the event of seizure or limitation of ownership promoted by third parties of the buyer’s assets, the buyer must immediately notify the seller.

The buyer, with express waiver of his domicile and jurisdiction, expressly submits to the competence and jurisdiction of the Courts and Tribunals of the city of Barcelona.

Returns will NOT be accepted that have not been informed by the buyer and accepted by the seller. Returns will have a maximum period of 30 days from leaving our warehouse. All returns will have a charge to the buyer of 15% of the value of the merchandise for handling, preparation and packaging. The cost of return transportation will be borne by the buyer.

Returns of materials manufactured expressly or to measure, outside the usual standard, will not be accepted.
